(Cap 478 section 74(2)) [2 September 1996] L.N. 342 of 1996 (L.N. 7 of 1996) Cap 478Z s 1 (Omitted as spent) (Omitted as spent) (Enacted 1996) Cap 478Z s 2 Interpretation In these Rules, unless the context otherwise requires- "approved" (认可) means approved by the Authority; "certificate of proficiency in fast rescue boats" (快速救援艇熟练操作证书) means a certificate issued under section 4A; (L.N. 106 of 1998) "certificate of proficiency in survival craft and rescue boats" (救生艇筏及救援艇熟练操作证书) means a certificate issued under section 4; (L.N. 106 of 1998) "Examination Centre" (考试中心) means the Examination Centre of the Marine Department; "examiner" (主考人员) means a person appointed to be an examiner under section 74(1) of the Ordinance; "fast rescue boat" (快速救援艇) means a boat complying with the requirements of the Guidelines for Fast Rescue Boats adopted by the International Maritime Organization by resolution A.656(16); (L.N. 106 of 1998) "rescue boat" (救援艇) means a boat designed to rescue persons in distress and to marshal survival craft; (L.N. 106 of 1998) "responsible authority" (负责当局), in relation to a training school or course, means the person in charge of that school or course, as the case may be "survival craft" (救生艇筏) means a craft capable of sustaining the lives of persons in distress from the time of abandoning the ship. (L.N. 106 of 1998) (Enacted 1996) Cap 478Z s 3 Conditions for the grant of a certificate of proficiency in survival craft and rescue boats (1) An applicant for a certificate of proficiency in survival craft and rescue boats shall have- (L.N. 106 of 1998) (a) attained 18 years of age; (b) attended an approved basic sea survival course; (c) completed sea service of not less than 12 months, or such shorter period as the Authority may allow having regard to the applicant's completion of an approved survival craft training course; (d) satisfied an examiner by practical demonstration, as required, of his ability to carry out the tasks listed in Part I of Schedule 1; (e) satisfied an examiner that he is familiar with the matters relating to launching and operation of survival craft, rescue boats and survival at sea listed in Part II of Schedule 1; and (f) satisfied an examiner that he has sufficient knowledge of the English language to understand, or give, any necessary orders that may be given to or by him in the course of his duties in connection with survival craft and rescue boats.(2) Every application to take an examination for a certificate of proficiency in survival craft and rescue boats shall conform with the provisions of Schedule 2. (L.N. 106 of 1998) (Enacted 1996) Cap 478Z s 3A Conditions for the grant of a certificate of proficiency in fast rescue boats (1) An applicant for a certificate of proficiency in fast rescue boats shall hold a certificate of proficiency in survival craft and rescue boats and shall have- (a) attained 18 years of age; (b) attended an approved training course; (c) satisfied an examiner by practical demonstration, as required, of his ability to carry out the tasks listed in Part I of Schedule 1A; (d) satisfied an examiner that he is familiar with the matters relating to the launching and operation of fast rescue boats listed in Part II of Schedule 1A; and (e) satisfied an examiner that he has sufficient knowledge of the English language to understand, or give, any necessary orders that may be given to or by him in the course of his duties in connection with fast rescue boats.(2) Every application to take an examination for a certificate of proficiency in fast rescue boats shall conform with the provisions of Schedule 2. (L.N. 106 of 1998) Cap 478Z s 4 Issue of certificate of proficiency in survival craft and rescue boats (1) Subject to subsection (2), the Authority shall, if satisfied that the applicant has fulfilled the requirements of section 3, issue a certificate of proficiency in survival craft and rescue boats upon payment of the prescribed fee. (2) Before issuing a certificate of proficiency in survival craft and rescue boats, the Authority may require the applicant to produce to him certificates or other documents showing to his satisfaction that the applicant has fulfilled the requirements of section 3. (L.N. 106 of 1998) (3) (Repealed L.N. 106 of 1998) (4) Any applicant aggrieved by a decision of the Authority to refuse to issue him a certificate of proficiency in survival craft and rescue boats may appeal against the decision to the Administrative Appeals Board except where the only reason for the refusal is that the applicant has not paid the prescribed fee referred to in subsection (1). (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 4A Issue of certificate of proficiency in fast rescue boats (1) Subject to subsection (2), the Authority shall, if satisfied that the applicant has fulfilled the requirements of section 3A, issue a certificate of proficiency in fast rescue boats upon payment of the prescribed fee. (2) Before issuing a certificate of proficiency in fast rescue boats, the Authority may require the applicant to produce to him certificates or other documents showing to his satisfaction that the applicant has fulfilled the requirements of section 3A. (L.N. 106 of 1998) Cap 478Z s 5 Record of certificates A record of all certificates of proficiency in survival craft and rescue boats and certificates of proficiency in fast rescue boats issued under these Rules and of the suspension, cancellation or alteration of, and any other matters affecting such certificates, shall be kept by the Authority. (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 6 Lost, etc., certificates (1) Subject to subsection (2), where a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats issued to any seafarer has been lost, defaced or destroyed, the Authority may, upon payment of the prescribed fee, issue to the seafarer another certificate in like terms, and any such certificate so issued shall, for the purposes of these Rules, have the same effect as the certificate lost, defaced or destroyed, as the case may be. (2) The Authority- (a) shall not issue a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats pursuant to subsection (1) to a seafarer unless the seafarer supplies the Authority with such information as the Authority requires to satisfy the Authority that the certificate which it will replace has in fact been lost, defaced or destroyed; and (b) may waive or reduce the prescribed fee referred to in subsection (1) where he is satisfied that the certificate concerned has been lost, defaced or destroyed without fault on the part of the seafarer to whom it was issued. (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 7 Re-examination (1) If the Authority is of the opinion that the holder of a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats is, due to his age, illness, physical disability or general inefficiency, likely to be incapable of performing his duties, the Authority may by notice in writing to the holder of the certificate require him to undergo within the period specified in the notice a re-examination based on the syllabus specified in Schedule 1 in the case of a certificate of proficiency in survival craft and rescue boats or the syllabus specified in Schedule 1A in the case of a certificate of proficiency in fast rescue boats and conducted in accordance with Schedule 2. (2) If the holder of a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats who is required to undergo a re-examination under subsection (1)- (a) does not pass the examination; (b) is not permitted to take or complete the re-examination pursuant to section 5(2) of Schedule 2; or (c) fails or refuses without reasonable excuse to undergo the re-examination within the period specified in the notice,the Authority may by notice in writing sent to the holder cancel the certificate. (3) Where a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats is cancelled under subsection (2) the holder shall forthwith deliver the certificate to the Authority. (4) Any person aggrieved by a decision of the Authority to cancel under subsection (2) his certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats may appeal against the decision to the Administrative Appeals Board. (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 8 Saving (1) A certificate issued under the repealed Rules and in force immediately before the commencement of these Rules shall be deemed to be a certificate issued under these Rules, and the provisions of these Rules shall apply accordingly. (2) For the purposes of this section, "repealed Rules" (已废除的规则) means the Merchant Shipping (Certificates of Proficiency in Survival Craft) Rules (Cap 281 sub. leg.) repealed by the Ordinance. (3) A certificate of proficiency in survival craft issued or deemed to be issued under these Rules and in force immediately before the commencement of the Merchant Shipping (Seafarers) (Certificates of Proficiency in Survival Craft) (Amendment) Rules 1998 (L.N. 106 of 1998) shall be deemed to be a certificate of proficiency in survival craft and rescue boats, and the provisions of these Rules shall apply accordingly. (L.N. 106 of 1998) (Enacted 1996) Cap 478Z Sched 1 SYLLABUS FOR A CERTIFICATE OF PROFICIENCY IN SURVIVAL CRAFT AND RESCUE BOATS [sections 3(1)(d) & (e) & 7(1)] Each candidate will be required to satisfy the examiner- (a) by practical demonstration, as required, of his ability to carry out the tasks listed in Part I; and (b) that he is familiar with the matters relating to the launching and operation of survival craft, rescue boats and survival at sea listed in Part II. PART I 1. Each candidate will be required to act as the person in charge and also to take part in the practical operations of launching and boarding survival craft and rescue boats, clearing the ship or dock side quickly, handling whilst afloat and disembarkation from and the recovery of survival craft and rescue boats. 2. Each candidate will be expected to know the allocation of duties for the craft in use, the orders commonly used in the operations of launching, handling and recovery, and in particular the specific commands "STILL" and "CARRY ON". 3. Each candidate will be required to demonstrate that he is able to don a lifejacket correctly, don and use an immersion suit and use a thermal protective aid. 4. Each candidate will be required to demonstrate that he can interpret the markings on survival craft and rescue boats with respect to the number of persons any such craft or boat is permitted to carry. 5. Each candidate will be required to demonstrate that he is able to row, steer, erect a mast, set the sails, manage a boat under sail and steer by compass. 6. Each candidate will be required to demonstrate that he is able to use signalling equipment, including rocket parachute flares, hand flares, buoyant smoke signals and radio life-saving appliances. Provisions The apportionment of food and water carried in survival craft. Cap 478Z Sched 1A SYLLABUS FOR A CERTIFICATE OF PROFICIENCY IN FAST RESCUE BOATS [sections 3A(1) & 7(1)] Each candidate will be required to satisfy the examiner- (a) by practical demonstration, as required, of his ability to carry out the task listed in Part I; and (b) that he is familiar with the matters relating to the launching and operation of fast rescue boats listed in Part II. PART I 1. Each candidate will be required to act as the person in charge and also to take part in the practical operations of launching and boarding a fast rescue boat, clearing a fast rescue boat quickly, handling whilst afloat and disembarkation from and the recovery of a fast rescue boat. 2. Each candidate will be required to demonstrate that he can- (a) control safe launching and recovery of a fast rescue boat; (b) right a capsized fast rescue boat; (c) handle a fast rescue boat in prevailing weather and sea conditions; (d) swim in special equipment; (e) use communication and signalling equipment between the fast rescue boat and a helicopter and a ship; (f) use the emergency equipment carried in a fast rescue boat; (g) recover a casualty from the water and transfer a casualty to a rescue helicopter or to a ship or to a place of safety; (h) carry out search patterns, taking account of environmental factors; (i) operate a fast rescue boat engine. PART II 1. Construction and outfit of fast rescue boats and individual items of their equipment. 2. Particular characteristics and facilities of fast rescue boats. 3. Safety precautions to be taken during launching and recovery of fast rescue boats. 4. Procedures for righting a capsized fast rescue boat. 5. Handling characteristics of fast rescue boats in prevailing and adverse weather and sea conditions. 6. Navigation and safety equipment available on fast rescue boats. 7. Search patterns and environmental factors affecting their execution. 8. Assessment of the readiness of fast rescue boats and related equipment for immediate use. 9. Maintenance, emergency repairs, normal inflation and deflation of buoyancy compartments of inflated fast rescue boats. 10. Methods of starting and operating a fast rescue boat engine and its accessories. (L.N. 106 of 1998) Cap 478Z Sched 2 PROCEDURE FOR EXAMINATION FOR A CERTIFICATE OF PROFICIENCY IN SURVIVAL CRAFT AND RESCUE BOATS AND CERTIFICATE OF PROFICIENCY IN FAST RESCUE BOATS [sections 3(2), 3A(2) & 7(1) & (2)(b)] (L.N. 106 of 1998) 1. Application for examination (1) Every application to be examined for a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats shall be made to the Examination Centre. (L.N. 106 of 1998) (2) Every application to be examined shall be made on a form obtainable from the Examination Centre and shall be accompanied by- (a) an employment registration book, service record book, discharge book or such other evidence as may be necessary to establish to the satisfaction of the examiner that the applicant has performed the sea service specified in section 3 of these Rules; (b) a certificate of attendance at an approved basic sea survival course (unless attendance is officially recorded in the applicant's employment registration book, service record book or discharge book); and (c) 2 suitable identical passport-size photographs of the applicant. (3) Every application when completed shall be lodged with the examiner, who shall, if satisfied that the applicant is eligible to take the examination, ensure that the applicant is notified of the arrangements made for the examination, or if not so satisfied, inform the applicant in writing that his application is refused, stating the reason for refusal. 2. Conduct of examinations for certificates of proficiency in survival craft and rescue boats and certificates of proficiency in fast rescue boats (1) Survival craft and rescue boats to be used in the examination must comply with the requirements of the Merchant Shipping (Safety) (Life-Saving Appliances) Regulation (Cap 369 sub. leg.) and the full range of equipment prescribed in those Regulations must be available during the examination. (L.N. 160 of 2001) (1A) Fast rescue boats to be used in the examination must comply with the requirements of the Guidelines for Fast Rescue Boats adopted by the International Maritime Organization by resolution A.656(16) and the full range of equipment prescribed in those Guidelines must be available during the examination. (L.N. 106 of 1998) (2) Candidates will be required to wear lifejackets throughout the examination unless the examiner, at his discretion, allows them to be removed during a portion of the examination. (3) On the completion of the examination, the examiner shall inform the applicant of the result, record the result on the form of application and submit the form to the Authority. (L.N. 106 of 1998) 3. Examinations at training schools An examination for a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats may, in the case of a person undergoing an approved course of pre-sea training at an approved nautical school, be taken by that person at that school during the course in accordance with approved arrangements made by the responsible authority. Issue of certificates of proficiency in survival craft and rescue boats and certificates of proficiency in fast rescue boats The Authority shall, if satisfied that an applicant is entitled to the grant of a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats, cause such a certificate to be issued to the applicant or, if not so satisfied, inform the applicant in writing that his application is refused, stating the reasons for the refusal. Verification of qualifications, etc. by examiner (1) The examiner shall not permit a candidate to take any examination under these Rules unless he is satisfied that the candidate is eligible to take the examination and is the person in respect of whom the application for examination has been made. (2) If before the commencement, or during the course, of an examination, the examiner becomes aware that a candidate has a physical or other disability which in his opinion would render the candidate incapable of performing the duties required in respect of survival craft, the examiner shall not permit the candidate to take or complete the examination. (3) Where pursuant to subsection (1) or (2) the examiner does not permit a candidate to take or complete the examination, the examiner shall state his reasons on the form of application and submit the form to the Authority. 6. Appeals from decisions of examiner Any candidate who is aggrieved by any decision of the examiner may appeal to the Authority within 30 days of being notified of such a decision.
