1 Article IObject of the AgreementIn accordance with Articles 6 and 92 of the Universal Postal Co-nvention [1989 Washington] and exchange of EMS items shall takeplace between Bhutan and TAIWAN (Rep. of China)Article 2DefinitionThe EMS service shall be the quickest postal service by physicalmeans. It shall consist of the collection, dispatch and deliveryin a very short space of time of correspondence, documents or g-oods.Article 3International EMS within the meaning of the present agreement C-ontrading administrations may operate the following type of EMS:On-demand itemsArticle 4On-demand itemsOn-demand items shall be accepted without any contractual arran-gement and without any previously laid down frequency.Article 5GoodsUnless the contrary is specified, EMS items may contain goods.Article 6Customs clearanceEach administration shall make all arrangements necessary for t-he fastest possible customs clearance of EMS items.Article 7Limits of weight and sizeEMS items shall be admitted up to a maximum weight of 20 kg. Th-ey may not exceed 1.50 metres for any one dimension or 3 metresfor the sum of the length and the greatest circumfrence measuredin a direction other than the length. Administrations may adoptother limits of weight and size.Article 8ChargesThe charges shall be set by the administration of posting of theEMS items.Article 9Prohibited articlesThe prohibitions provided for in the UPU Convention shall applyto EMS items as shall the restrictions on importation and trans-it given in the List of Prohibited Articles published by the In-ternational Bureau of the Universal Postal Union. Valuable arti-cles as defined in the Universal Postal Convention shall not beadmitted.Article 10ForwardingEMS items shall be sent by the fastest pre-arranged means of tr-ansport from the time of posting [or from the time they are col-lected from the sender] to delivery. Administrations shall cons-ult one another on this.Article 11Compensation in the event of imbalance in exchangesTerminal dues as defined in the Universal Postal Convention sha-ll not apply to EMS items. Each administration shall set, in theevent of imbalance in exchanges, a unit rate of compensation peritem corresponding to the costs. Administrations shall agree intheir reciprocal relations on the number of excess items abovewhich the unit rate of compensation shall be collected.Article 12LiabilityEach administration shall decide its own compensation policy inthe case of loss, damage, theft or delay. Payment of compensati-on, if any, shall be the sole responsibility of the administrat-ion of origin. Neither administration may claim indemnificationfrom the other administration.Article 13Undeliverable itemsAn item refused by the addressee or an undeliverable item shallbe returned to the sender by EMS at no extra charge.Article 14Reforwarding of mis-sent items or bagsEvery mis-sent EMS item or bag shall be reforwarded to its prop-er destination by the most direct means used for the EMS by theadministration which received it.Article 15InquiriesEach administration shall reply as soon as possible to requestsfor information in respect EMS items, The reply shall normallybe sent by the same means as that used for the corresponding re-quest for information [ie, by telex, telephone, EMS, electronicmail, etc.]Article 16Temporary suspension of serviceWhere justified by extraordinary circumstances, an administrati-on may temporarily suspend the service, The other administrationshall be informed immediately of such suspension and of the res-umption of the service, if need be by telegram, teliex, electro-nic mail or telephone,Article 17Application of the universal Postal ConventionThe Universal Postal Convention and its Detailed Regulatians sh-all be applicable by analogy in all cases not expressly governedby the Agreement and its Framework Regulations.Article 18AmendmentThis Memorandum of Understanding may be modified by mutual agre-ement on the basis of an exchange of letters including the textof the modified paragraph[s].Article 19Entry into foreeThis Memorandum of Understanding shall come into force on the d-ate mutually agreed upon by the administrations. it shall remainin operation until the expiration of twelve months from the dateon which notice of termination is given by either administration.Done at Thimphu on 10-2-1993Done at Taipei on Sept, 11, 1993in duplicate in English language[Signed][Signed]Director GeneralChieh-Kuei HsuPosts, Telegraphs and Civil Director GeneralWirelessDirectorate General of PostsGeneral Post Cffice Taipei, Taiwan, ROCThimphuBHUTAN
