AGREEMENT BETWEEN THE COMMERCIAL ARBITRATION ASSOCIATION OF THE REPUBLIC OF CHINA AND THE BOARD OF TRADE OF THAILAND (AD.1991.08.06)

1 The Commercial Arbitration Association of the Republic of China (referred to as the "Association") and the Board of Trade of Th-ailand (referred to as the "Board"), believing that wider use ofcommercial arbitration will contribute to the stability of econ-omic transactions between the Republic of China and Thailand, h-ave agreed as follows: Article 1 The Association and the Board shall each recommend enterprisesengaged in economic transactions between the Republic of Chinaand Thailand the insertion of the following arbitration clausein contracts between such enterprises: "All disputes that may arise between the parties out of or in r-elation to this contract shall be settled by arbitration underthe Chinese-Thai Arbitration Agreement. The place of arbitrationshall be, unless otherwise agreed between the Parties, the coun-try in which the respondent resides. In case the respondent isan enterprise of the Republic of China, the Arbitration shall beconducted by the Commercial Arbitration Association of the Repu-blic of China in accordance with the Commercial Arbitration Rul-es thereof." In case the respondent is an enterprise of Thailand, the arbitration shall be conducted by the Office of the Arbit-ration Tribunal attached to the Board of Trade of Thailand in a-ccordance with the Thai Commercial Arbitration Rules thereof. Article 2 (1) Any arbitrator shall not be limited to the national of eith-er country where the arbitration takes place. (2) The language of English shall, unless otherwise agreed betw-een the Parties, be used in the arbitration proceedings eit- her at the Office of the Arbitration Tribunal attached to the Board or at the Association. Article 3 The Association and the Board will co-operated to promote inter-national commercial arbitration between the two countries and will exchange all necessary information and opinions conduciveto the realization of this Agreement. Article 4 Believing that the bringing of their respective arbitration lawsand rules into closer harmony will contribute to the further s- tability and development in economic transactions between the e-nterprises of the two countries, the Association and the Boardwill exert every effort to this end. Article 5 This Agreement shall be called the "Chinese-Thai Arbitration Ag-reement". This Agreement is done in duplicate in English, both copies bei-ng equally authentic and shall become effective on September 1,1991.
