(Cap 369 sections 100 and 112) [2 August 1991] (L.N. 323 of 1991) Cap 369AK reg 1 Citation (1) These regulations may be cited as the Merchant Shipping (Safety) (Navigational Warnings) Regulations. (2) (Omitted as spent) (Enacted 1991) Cap 369AK reg 2 Interpretation (1) In these regulations, unless the context otherwise requires- "coast station" (海岸电台) means a station on land for the purpose of providing communication with ships by means of radio; "Hong Kong ship" (香港船舶) means a ship registered in Hong Kong; "signal station" (讯号台) means a station on land for the purpose of providing communication with ships by means other than radio; "tropical storm" (热带风暴) means a hurricane, typhoon, cyclone or other storm of a similar nature. (2) The master of a ship shall be deemed to have met with a tropical storm if he has reason to believe that such a storm is in his vicinity. (Enacted 1991) Cap 369AK reg 3 Information on navigational dangers to be sent by master of ship (1) The master of a Hong Kong ship shall, on meeting with- (a) dangerous ice; (b) a dangerous derelict; (c) subfreezing air temperatures associated with gale force winds causing severe ice accretion on the superstructure of ships; (d) winds of force 10 or above on the Beaufort Scale for which no storm warning has been received; (e) a tropical storm; or (f) any other direct danger to navigation,send, by all means of communication at his disposal, information relating to the matters set out in the Schedule. (2) The information referred to in subregulation (1) shall- (a) be sent, in addition to ships in the vicinity, to the person in charge for the time being of the nearest coast station or signal station with which it is possible for the ship to communicate, and if sent to a person in charge of a signal station shall be accompanied by a request that it be sent forthwith to the nearest coast station; (b) be sent in English or by means of the International Code of Signals; and (c) when sent by means of radio, commence with an indication of the nature of the danger to which it relates and be preceded by the safety signal consisting, if the information is sent by radio telegraphy, of the group TTT in the Morse Code, repeated 3 times, with the letters of each group and the successive groups clearly separated from each other, or if the information is sent by radiotelephony, of the spoken word "SECURITE" (pronounced "SAY-CURE-E-TAY") repeated 3 times. (Enacted 1991) Cap 369AK reg 4 Penalty for non-compliance A master of a ship who without reasonable excuse fails to send information as required under regulation 3 commits an offence and is liable to a fine of $20000. (Enacted 1991) Cap 369AK reg 5 Amendment of Schedule The Director of Marine may amend the Schedule by notice published in the Gazette. (Enacted 1991) Cap 369AK SCHEDULE [regulations 3 & 5] 1. On meeting with dangerous ice, a dangerous derelict or any other direct danger to navigation (except the dangers mentioned in paragraphs 2, 3 and 4) the master of the ship shall send information relating to the following matters- (a) the kind of ice, derelict or other danger observed; (b) the position of the ice, derelict or other danger when last observed; and (c) the Universal Co-ordinated Time and date when the danger was last observed. On meeting with a tropical storm the master of the ship shall send information relating to the following matters- (a) the position of the storm so far as it can be ascertained, together with the Universal Co-ordinated Time and date when the storm was encountered; and (L.N. 12 of 1992) (b) the position, true course and speed of the ship when the observation was made.In addition the master of the ship shall send as much of the following information as is practicable- (i) the barometric pressure, corrected if possible, indicating whether such pressure is given in millibars, inches or millimetres and whether the reading is corrected or uncorrected; (ii) the change in barometric pressure during the previous 3 hours; (iii) the true direction of the wind; (iv) the wind force according to the Beaufort Scale; (v) the state of the sea (smooth, moderate, rough or high); (vi) the swell (slight, moderate or heavy) and the true direction from which it comes; and (vii) the period or length of the swell (short, average or long). 3. On encountering winds of force 10 or above on the Beaufort Scale (not being a tropical storm) for which no storm warning has been received the master of the ship shall send the same information as that listed under paragraph 2 but excluding details concerning the state of the sea and the swell. 4. On encountering subfreezing air temperatures associated with gale force winds causing severe ice accretion on the superstructure of ships the master of the ship shall send information relating to the following matters- (a) the Universal Co-ordinated Time and date when the encounter was made; (L.N. 12 of 1992) (b) the air temperature and (if practicable) the sea temperature at such time; and (c) the force of the wind encountered (Beaufort Scale) and the true direction thereof.
