EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF THE REPUBLIC OF CHINA AND THE GOVERNMENT OF KOREA CONCERNING MUTUAL THE SAFETY OF LIFE AT SEA (AD.1981.02.17)

1 Ⅰ Note from the Embassy of the Republic of China, to the Minis-try of Foreign Affairs of the Republic of Korea. The Embassy of the Republic of China presents its compliments tothe Ministry of Foreign Affairs of the Republic of Korea and,wi-th reference to the implementation of 1974 International Conven-tion for the Safety of Life at Sea (1974 SOLAS), has the honorto inform the Ministry that given mutual desire to ensure the c-ontinution of uninterrupted Maritime trade and the safety of li-fe at sea, the Republic of China and the United States have agr-eed to mutually implement 1974 SOLAS and thus to propose that t-he Republic of Korea and the Republic of China may also reach anagreement to the same end on the basis of reciprocity and equal-ity under the following conditions: (1) All ships registered in the Republic of Korea which are usedin trade with the Republic of China should have been inspec-ted and are in compliance with the requirements of the 1974International Convention for the Safety of Life at Sea (1974SOLAS). Compliance with the 1974 SOLAS Convention requireme-nts will be indicated by the carriage aboard ships register-ed in the Republic of Korea of valid certificates attestingto that fact. Such certificates shall be in the same form asthose called for in the Appendix (pp. 230-243) to the 1974SOLAS and subject to the control Provisions of Regulation 19of 1974 SOLAS. Their carriage shall enable ships registeredin Korea to trade at the ports of the Republic of China inthe same manner and under the same conditions as ships of t-he parties to the 1974 SOLAS Convention. (2) Reciprocally, assurances should be provided that inasmuch asthe Republic of China (ROC) is not a party to the 1974 SOLASConvention, the carriage aboard ROC merchant ships of validcertificates which is in compliance with the 1974 SOLAS Con-vention requirements, will enable them to trade at the portsof the Republic of Korea in the same manner and under the s-ame conditions as ships registered in the Republic of Chinatrade at ports of signatories to the 1974 SOLAS Convention.It would be much appreciated if the Ministry will be kind e-nough to forward the above-mentioned proposal to the Koreancompetent Authorities for favorable consideration. If these arrangements meet with the approval of the KoreanAuthorities, the Government of the Republic of China propos-es that this Note and the Ministry's Note in reply serve asa basis to establish the procedures described. The copies of the above-mentioned Appendix (pp. 230-243) andthe control provisions of Regulations 19of 1974 SOLAS are e-nclosed herewith for the Ministry's reference. The Embassy of the Republic of China avails itself of thisopportunity to renew to the Ministry of Foreign Affairs ofthe Republic of Korea the assurances of its highest conside-ration. In connection with the implementation of the arrangement, t-he Government of the Republic of Korea wishes to propose th-at the arrangement shall be applied as of 31 March 1981 when1974 SOLAS Convention will enter into force for the Republicof Korea. The Ministry of Foreign Affairs avails itself of this oppor-tunity to renew to the Embassy of the Republic of China theassurances of its highest consideration. The Embassy of the Republic of China presents its compliments tothe Ministry of Foreign Affairs of the Republic of Korea and hasthe honor to acknowledge the receipt of the latter's Note No. O-ZY/51 dated January 21, 1981 concerning the mutual implementati-on of 1974 International Convention for the Safety of Life at Sea (1974 SOLAS). In reply, the Embassy has further the honor to inform the Minis-try that the Government of the Republic of China is agreeable tothe proposal as set forth in the aforesaid Ministry's Note to t-he effect that the mutually agreed arrangement shall be applied as of 31 March 1981 when 1974 SOLAS Convention will enter intoforce for the Republic of Korea, and to confirm that the Minist-ry's Note and this Note thereto shall constitute an agreement onthis matter shall constitute an agreement on this matter betweenthe Government of the Republic of Korea and the Government of t-he Republic of China.
