(Cap 483 sections 35 and 36) [Parts I, II, III (other than section 11), IV, V, VI and XI and Schedules 3 and 4 : 16 January 1998 L.N. 41 of 1998 Section 11 and Part VIII : 15 June 1998 The remaining provisions : 19 June 1998 L.N. 241 of 1998] (L.N. 10 of 1998) Cap 483A s 1 (Omitted as spent) PART I PRELIMINARY (Omitted as spent) Cap 483A s 2 Interpretation In this Bylaw, unless the context otherwise requires- "Air Traffic Control" (空中交通管制) means the air traffic control unit, as defined in the Air Navigation (Hong Kong) Order 1995 (Cap 448 sub. leg.), for the time being operating at the Airport; "Airport Management Director" (机场管理总监) means a person appointed to such position by the Authority; "Airside Vehicle" (机场限制区车辆) means a vehicle permitted to be used or driven in the Restricted Area under section 46, but does not include the Automated People Mover; "Airside Vehicle Licence" (机场限制区车辆牌照) means a licence issued by the Authority for an airside vehicle pursuant to section 46; "apron" (停机坪) means the area within the Airport intended to accommodate aircraft for purposes of loading or unloading passengers, mail or cargo, fuelling, parking or maintenance; "Apron Control" (停机坪管制) means the apron control centre set up by the Authority for the provision of apron management services and for the time being operating at the Airport; "Authorized Officer" (获授权人员) means the person referred to in section 35(10)(a), (b), (c) or (d) of the Ordinance; "Authorized Person" (获授权人) means a person appointed pursuant to section 59(1); "Automated People Mover" (旅客捷运系统列车) means the automated transportation system in the form of trains for carrying passengers between stations within the Airport; "Bylaw Area" (附例适用区) means the area to which this Bylaw applies as described in section 3; "designated road" (指定道路) means any road or length of road which is for the time being designated by the Commissioner for Transport under section 36(4) of the Ordinance; "driver" (司机) has the same meaning as defined in section 2 of the Road Traffic Ordinance (Cap 374); "driving licence" (驾驶执照) has the same meaning as defined in section 2 of the Road Traffic Ordinance (Cap 374); "Government Site" (政府用地) or "Government Accommodation" (政府房舍) means a Government Site or a Government Accommodation designated as such under the Land Grant; "GTC" (地面运输中心) means the ground transportation centre at the Airport; "manoeuvring area" (飞机运转区) means that part of the Airport to be used for the take-off, landing and taxiing of aircraft, excluding the apron; "movement area" (飞机移动区) means that part of the Airport to be used for the take-off, landing and taxiing of aircraft, consisting of the manoeuvring area and the apron; "MTR Area" (地下铁路区) means such part or parts of the areas sub-let by the Authority to the MTR Corporation Limited and delineated for the purposes of this Bylaw as MTR Area; (13 of 2000 s. 65) "operator of an aircraft" (飞机营运人) means a person, organization or enterprise engaged in or offering to engage in an aircraft operation; "PTB" (客运大楼) means the passenger terminal building at the Airport; "Public Area" (公众区) means an area within the Bylaw Area which is not part of the Restricted Area or the Sub-Leased Area, access to which is open to the public and not restricted only to persons or vehicles specifically authorized by the Authority; "public car park" (公众停车场) means any car park that is not within the Restricted Area and any part of which is open to the public, whether operated by the Authority directly or by other operators and whether or not a fee for parking is chargeable; "public service vehicle" (公共服务车辆) means any public service vehicle as defined in section 2 of the Road Traffic Ordinance (Cap 374); "public transport facilities" (公共运输设施) means- (a) any public ferry terminal; and (b) any area not forming part of the GTC and designated for the time being by the Authority for the waiting by a public service vehicle for passengers, or for the waiting, boarding and alighting of passengers to and from a public service vehicle;"security device" (保安器材) means a device designed or adapted to be installed in any premises or place for the purpose of detecting or recording- (a) the occurrence of any offence; or (b) the presence of an intruder or of an object that a person is, for reasons of security, not permitted to bring onto the premises or place or any other premises or place;"Sub-Leased Area" (分租区) means an area within the Bylaw Area but not being an area within the Restricted Area, the PTB, the GTC, the public car parks or the public transport facilities, which- (a) the Authority has sub-let or licensed to another party; or (b) is a Government Site or a Government Accommodation;"Terms of Use" (使用条款) means any terms, conditions, procedures, circulars, instructions and/or directions relating to the availability of or the access to, or the use or operation of, any part of the Airport and/or its services or facilities, issued from time to time by the Authority, of which notice has been given by the Authority in accordance with section 60; "traffic warden" (交通督导员) has the same meaning as defined in section 2 of the Road Traffic Ordinance (Cap 374); "vehicle" (车辆) has the same meaning as defined in section 2 of the Road Traffic Ordinance (Cap 374). Cap 483A s 3 Bylaw Area PART II GENERAL (1) Unless otherwise expressly provided in this Bylaw, this Bylaw shall apply to the entire Bylaw Area. (2) The Bylaw Area shall comprise- (a) all the Restricted Area; (b) all that portion of the Airport Area no part of which is either in the Restricted Area or on any road or length of road; and (c) all the designated roads,but shall not include any area within an area referred to in paragraph (a), (b) or (c) which is also within the MTR Area. Cap 483A s 4 Sub-Leased Areas Parts IV, V, VII and VIII shall not apply to the Sub-Leased Areas. Cap 483A s 5 Gazette notice and plans (1) The Authority may, by notice published in the Gazette, describe and delineate by reference to a plan or plans the areas for the time being forming the Bylaw Area, the Sub-Leased Areas, the MTR Area, the PTB, the GTC, the designated roads, the public car park and the public transport facilities. (2) The Airport Management Director may prepare and certify a plan or plans delineating the areas forming the Bylaw Area, the Sub-Leased Areas, the MTR Area, the PTB, the GTC, the designated roads, the public car park and the public transport facilities and shall from time to time prepare and certify a new plan or plans in substitution thereof and may from time to time endorse on such plans or substituted plans any amendment thereto and certify such endorsement. (3) A copy of every plan certified under this section shall be made available by the Authority for inspection at the Airport. (4) Unless the contrary is proved, the production of a plan published under this section shall, for the purposes of the Ordinance or any legal proceedings (including a prosecution under the Ordinance), be taken to be sufficient proof of the area or areas delineated for the time being in force. Cap 483A s 6 Public officers, etc. (1) Sections 9, 11(2), 12 and 48(7), (8), (9), (12) and (14) shall not apply to, and sections 9, 46(1) and 48(2) shall not apply in respect of a vehicle or vessel being used by, a police officer, an immigration officer or immigration assistant, an officer of the Fire Services Department, a member of the Garrison, a member of the Customs and Excise Service within the meaning of the Customs and Excise Service Ordinance (Cap 342), the Commissioner, the Deputy Commissioner or an officer of the Independent Commission Against Corruption when he is acting in the course of duty in such circumstances of urgency that the performance of his duty might be frustrated or seriously impaired if the said sections were to apply to him or in respect of the vehicle or vessel being used by him. (2) Save as provided in subsection (1), this Bylaw shall apply to all public officers and the vehicles and vessels in use. Cap 483A s 7 Aviation Security Ordinance This Bylaw shall not be taken as prejudicing the application and enforcement of the Aviation Security Ordinance (Cap 494) or any subsidiary legislation thereunder. Cap 483A s 8 Exemption The Authority may exempt any person, vehicle, vessel or animal, or class of person, vehicle, vessel or animal, from all or any of this Bylaw subject to such conditions and for such period of time as the Authority may determine. Cap 483A s 9 Admission, etc. PART III ADMISSION AND ACCESS (1) Subject to subsection (2), the Authority may at any time- (a) refuse to admit to, or request the leaving of or removal from, the Bylaw Area, or any particular part thereof, which is not a Sub-Leased Area; or (b) request the moving from one particular place within the Bylaw Area which is not a Sub-Leased Area to another such place,any person, animal, vehicle, vessel, article or thing. (2) The powers provided in subsection (1) may not be exercised in relation to an area which is a designated road, a public transport facility, a public car park or a Public Area within the GTC or the PTB unless the Authority, or the Authorized Person or Authorized Officer, in exercising such power- (a) reasonably considers it necessary in the interests of the safe, secure and efficient operation of the Airport; or (b) reasonably believes or suspects that the person against whom such power is to be exercised has contravened, or attempted to contravene, a provision of the Ordinance, or regulations made thereunder, or any of this Bylaw.(3) No person shall- (a) continue to remain or stay in; or (b) fail or refuse to remove or move such animal, vehicle, vessel, article or thing in his control from,the Bylaw Area, or, as the case may be, that particular part of the Bylaw Area, where admission of that person, animal, vehicle, vessel, article or thing is refused or a request to leave, remove or move therefrom is made pursuant to this Bylaw. (4) The Authority may remove from the Bylaw Area or, as the case may be, any particular part thereof, any person, animal, vehicle, vessel, article or thing (where necessary, by the used of reasonable force) which continues to remain or stay in such area in breach of this section without incurring any liability (other than liability for negligence or wilful default) to any person for any loss or damage however arising as a result of such removal. Cap 483A s 10 Conditions of admission (1) Admission to any part of the Bylaw Area which is not a Sub-Leased Area, or the use of any facilities therein, shall be subject to this Bylaw and the Terms of Use relating to such area, building and facility. (2) Every person while in the Bylaw Area shall observe and comply with- (a) this Bylaw; (b) any relevant Terms of Use; (c) all directions and instructions of an Authorized Person or an Authorized Officer given in the course of the carrying out of his duty for the purpose of the safe and secure operation of the Airport, or securing the safety of aircraft, vehicles and persons using the Airport, or the preventing of danger to the public, or the prevention of obstruction within the Airport; and (d) all signs, notices, indicators and other directions erected or displayed by the Authority including those prohibiting or restricting access or directing the routes or means of access to any part or parts of any area, building or facility. Cap 483A s 11 Restricted Area (1) Without prejudice to the generality of section 10, the Authority may regulate the access to and the conduct of persons in the Restricted Area by issuing or authorizing the issue of permits to such persons as the Authority may from time to time consider appropriate. Such permits may be subject to such terms and conditions as the Authority may from time to time determine to be necessary for the safe and secure operation of the Airport. (2) No person other than a bona fide airline passenger shall, while in the Restricted Area and without lawful authority or reasonable excuse, fail to wear a valid permit issued or authorized to be issued by the Authority or, in the case of an air crew member, a valid military identification document or an air crew identity card issued by an air carrier or an aviation authority in such manner as may be acceptable to the Authority, so that it is reasonably visible at all times. Cap 483A s 12 Closure Notwithstanding any other provisions of this Bylaw, the Authority may at any time limit access to or close any part or parts of the Bylaw Area if the Authority, in its absolute discretion, considers it to be expedient for the purpose of the safe and secure operation of the Airport, or necessary for the carrying out of works. Cap 483A s 13 Misuse of facilities PART IV FACILITIES No person shall, without lawful authority or reasonable excuse- (a) interfere with or impede the operation or proper use of, or tamper with, obscure, damage or misuse- (i) any operating system, including but not limited to any telephone system, information or data system, computer system, telecommunications system or other apparatus provided for transmitting and receiving of messages at the Airport, announcement system, ventilation system, baggage handling system, trolley recirculation system, lighting system and sign or signal system; (ii) any conveyance system or facility for passengers or goods, including but not limited to any Automated People Mover, escalator, travelator, moving platform or lift and its related system, installation or equipment; (iii) any machine, equipment, appliance, plant, installation, apparatus, device, tool or system, whether mechanical, electrical or otherwise, including but not limited to any automatic door or gate, vehicle and baggage trolley; (iv) any wiring or cable or other form of electrical installation; (v) any safety or alarm or emergency system or device; (vi) any security device; or (vii) any drainage, sewerage, water supply, gas supply, power supply or other utility supply system, in, installed at or forming any part of the Bylaw Area;(b) except in the case of an emergency and for the express purpose for which the same is provided, intentionally move or work any lever, button, switch or control of, or operate, or activate, any alarm or emergency or safety system or device in, installed at or forming any part of the Bylaw Area; (c) move or work any lever, button, switch or control, or operate any operating system, conveyance system or facility, machine, equipment, appliance, plant, installation, apparatus, device, tool, system or security device referred to in paragraph (a)(i), (ii), (iii), (iv) and (vi); (d) ascend, or descend, or attempt to ascend or descend, by means of any escalator other than in such manner and order as is directed by the Authority; (e) travel, or attempt to travel, upon any escalator, travelator, moving platform or other automatic conveyance in a direction other than the direction in which it is moving; (f) sit upon any escalator, travelator or any other automatic conveyance for passengers or goods including the handrails thereof except in seats, if any, designated or designed for such purposes; or (g) except in case of accident or other emergency- (i) enter or leave, or attempt to enter or leave, a compartment or carriage of the Automated People Mover whilst it is in motion or between designated stops; or (ii) open, or attempt to open, any automatic door or gate at a platform or area designated for the embarking or disembarking of passengers whilst it is closed or going through such door or gate for any purpose other than the embarking on or disembarking from the Automated People Mover. Cap 483A s 14 Graffiti and vandalism No person shall, without lawful authority or reasonable excuse, deface, remove or detach, or write, paint, draw or affix any word, representation or character upon, or soil, defile, break, cut, scratch, tear, spray or damage- (a) any buildings, structures, walls or other facilities; (b) any fixture, furniture, decoration, fittings or other property including but not limited to any sign, notice or road marking; or (c) any machine, operating system, equipment, plant, apparatus, device or system referred to in section 13, including the surfaces thereof. Cap 483A s 15 Fire PART V PUBLIC ORDER AND CONDUCT No person shall- (a) cause an outbreak of fire; (b) light any naked flame at any place within the movement area except with the prior permission of the Authority; or (c) light any naked flame at any other place where such act is prohibited by notice displayed thereat. Cap 483A s 16 Smoking and non-smoking area (1) No person shall smoke or take with him a lighted cigarette, cigar or pipe in any part of the Restricted Area, the PTB, the GTC, the public transport facilities or the public car parks except in an area designated by the Authority as a smoking area. (2) An Authorized Person or an Authorized Officer may, in respect of any person who is reasonably suspected of having committed or attempting to commit a breach of subsection (1)- (a) require the person to extinguish the lighted cigarette, cigar or pipe; and (b) where the person fails to extinguish the lighted cigarette, cigar or pipe, require him to leave the area. Cap 483A s 17 Nuisance and annoyance (1) No person shall conduct himself in any part of the Bylaw Area so as to cause a nuisance or annoyance to other persons. (2) Except with the permission of the Authority, no person shall- (a) undertake any musical, theatrical or other performance in whatever form or manner; or (b) hold any meeting or assembly which causes any obstruction to the proper use or operation of the Airport.(3) No person shall while within the Bylaw Area be in a state of intoxication resulting from the consumption of any alcohol, medicine or drug. Cap 483A s 18 Obstruction No person shall, without lawful authority or reasonable excuse- (a) wilfully obstruct or interfere with- (i) the proper use of the Airport; or (ii) any Authorized Officer or Authorized Person in the execution of his duty or in the exercise of any powers conferred on him by this Bylaw; or(b) place any article or thing in any part of the Bylaw Area in such a way that may cause obstruction or restriction to movement of persons or vehicles. Cap 483A s 19 Restriction on use of language and behaviour No person shall at any time while in the Bylaw Area use any threatening, abusive, obscene or offensive language, or behave in a riotous, disorderly, indecent or offensive manner. Cap 483A s 20 Loitering (1) No person shall loiter in any part of the Bylaw Area without reasonable cause. An Authorized Officer or an Authorized Person may request a person to leave the Bylaw Area or any particular part thereof if that person is reasonably suspected of loitering in any part of the Bylaw Area without reasonable cause. (2) No person shall continue to remain without lawful authority or reasonable excuse after having been requested by an Authorized Officer or an Authorized Person to leave the Bylaw Area or any particular part thereof pursuant to subsection (1). Cap 483A s 21 Trespass No person shall occupy or settle on any site or space or put up any structures within the Bylaw Area save for the purposes permitted by the Authority. Cap 483A s 22 Use of vehicles, skateboards, etc. No person shall, without the prior permission of the Authority- (a) stop, park or use any vehicle (including an electric vehicle and a trailer, but excluding a vehicle used for transport by a disabled person) in any part of the PTB and the GTC which is not a road, parking area or other area designated for use by vehicles; or (L.N. 9 of 1998) (b) go, ride or move on any roller-skates, roller-blades, skateboard or other similar devices in any part of the Bylaw Area. Cap 483A s 23 Persons to keep animals under control (1) Except for dogs in the service of the police or the Customs and Excise Service of Hong Kong, or guide dogs accompanying persons with sight disability, or animals which are to travel on, or unloaded from, an aircraft, no person shall, without the permission of the Authority, bring any animal into any part of the Bylaw Area. (2) The person bringing the animal into the Bylaw Area shall at all times keep the animal on a lead or carried in a proper cage or container or under control by other appropriate means and shall not permit such animal to foul any part of the Bylaw Area or to cause a nuisance or annoyance to other persons. Cap 483A s 24 Dumping (1) No person shall, without the prior permission in writing of the Authority, dump, abandon or leave behind any vehicles, equipment, construction debris, waste matter, rubbish, refuse or unwanted articles of any kind on any part of the Bylaw Area. (2) In addition and without prejudice to the right of the Authority under section 58, the Authority may, without any notice to the owner thereof, remove and dispose of any such vehicles, equipment, construction debris, waste matter, rubbish, refuse or unwanted articles abandoned or left on any part of the Bylaw Area in breach of subsection (1) in such manner and at such time as the Authority sees fit. The Authority shall incur no liability whatsoever to any person for such removal or disposal other than liability for negligence or wilful default and no claim for damages or compensation shall be brought against the Authority by any person in respect of the same. Cap 483A s 25 Littering, spitting or other unhygienic conducts (1) No person shall drop or leave litter other than in a receptacle designed or provided for such purpose. (2) No person shall spit or perform any other unhygienic conducts except in a receptacle or other facility designed or provided for such purpose. Cap 483A s 26 Hawking and touting (1) No person shall, without permission of the Authority, carry on any business, carry on any activity as a hawker, sell or distribute anything, conduct any survey, tout, solicit or invite persons to purchase, expose or offer anything for sale or hire or make any offer of services in any part of the Bylaw Area. (2) No person shall, without the permission of the Authority, distribute any book, leaflet or other written matter or any sample or other thing or article in any part of the Bylaw Area. Cap 483A s 27 Soliciting for alms, etc. No person shall beg or solicit for alms, funds or contributions of any kind without obtaining the permission of the Authority. Cap 483A s 28 Emergency exits and fire escape doors No person shall, without lawful authority or reasonable excuse, obstruct or lock, or cause to be obstructed or locked, any of the emergency exits of any buildings or wilfully leave the smoke control doors in any buildings open. Cap 483A s 29 Prohibition against climbing of walls, fences, posts, etc. No person shall, without lawful authority or reasonable excuse, climb or jump on or over any wall, fence, barrier, railing, turnstile or post in any part of the Bylaw Area. Cap 483A s 30 Restriction on consumption of food or beverages No person shall consume any food, beverages or alcoholic drinks while in any part of the PTB, the GTC or the public transport facilities where such act is prohibited by notice displayed thereat or any Terms of Use relating thereto. Cap 483A s 31 Restriction on taking of photographs, etc. No person shall, without the prior permission of the Authority, and subject to such terms and conditions as the Authority may impose- (a) use any sound or image recording equipment for any commercial purposes; or (b) use any sound or image recording equipment at any place within the Bylaw Area where the use of such equipment is expressly prohibited by a notice displayed thereat. Cap 483A s 32 Environment (1) No person shall fill any container with or discharge from any container, including any part of a vehicle, vessel or aircraft, any liquid fuel, oil or lubricants in any place in the Bylaw Area other than in a place approved or designated for such purpose by the Authority. (2) No person shall clean out, wash, service or maintain any aircraft, vehicle or equipment in any part of the Bylaw Area other than in a place approved or designated for such purpose by the Authority. Cap 483A s 33 Restriction on road and excavation works No person shall carry out any digging, road or excavation works in any part of the Bylaw Area, including but not limited to any place on or near any designated road or on any part of the movement area, without the prior permission in writing of the Authority. Cap 483A s 34 Informational signs The Authority may erect or maintain at any place within the Bylaw Area as it deems appropriate, static and variable signs and ground markings for airline or airport information. Cap 483A s 35 Flight safety hazard PART VI PROHIBITED ACTS Without prejudice to the provisions of the Air Navigation (Hong Kong) Order 1995 (Cap 448 sub. leg.), no person shall, within the Bylaw Area- (a) fly a kite, balloon or model plane, release a bird or launch a parascending parachute; or (b) drop or deposit anything in such circumstances as to cause or be likely to cause a flight safety hazard. Cap 483A s 36 Radio interference No person shall within the Bylaw Area operate or use any radio transmitter or other thing capable of radiating electrical or other interference in such a way as to adversely affect or be likely to adversely affect the operation of any communications or navigation systems at the Airport. Cap 483A s 37 Distribution schemes and arrangements No person shall, without the permission of the Authority, carry out, operate, engage in or participate in any scheme or arrangement for the delivery, collection or distribution of any commodities in or to any part of the Bylaw Area for the purpose of or in connection with any commercial or business operation or undertaking which is, or is held out to be, an operation or undertaking for the sale of or dealing in dutiable commodities on a duty free or duty discounted basis. Cap 483A s 38 Signs and advertisements (1) Without prejudice to any other enactment relating to advertisements, decorations or signs, no person shall- (a) erect any advertisement, decoration, flag, banner, emblem, notice or sign; or (b) post, stick, paint or write, or cause to be posted, stuck, painted or written, any placard, bill advertisement or any other matter,on any part of the Bylaw Area without the permission of the Authority. (2) The Authority may remove and dispose of any advertisement, decoration and sign which is exhibited in any part of the Bylaw Area without the permission of the Authority. Cap 483A s 39 Engine runs PART VII OPERATIONS IN THE MOVEMENT AREA No person shall start up or run an aircraft engine in the movement area without the prior permission of the Air Traffic Control. Cap 483A s 40 Aircraft ground movement No person shall, without lawful authority or reasonable excuse, tow or move or allow an aircraft to be towed or moved in the movement area without the prior permission of the Air Traffic Control. Cap 483A s 41 Removal of aircraft (1) The Authority may request the moving or removal of and, where such request is not promptly acceded to, the Authority may, at the risk of the owner or operator thereof, move or remove, or cause to be moved or removed, any aircraft, including any aircraft disabled or incapacitated for any reason while on the movement area, for security, safety or operational reasons as determined by the Authority. (2) The Authority may charge the owner or operator of an aircraft for the expenses incurred in moving or removing such aircraft pursuant to subsection (1) and recover such sums owing as a civil debt from the owner or operator of the aircraft. (3) Nothing in this section shall be taken or construed to the prejudice of the provisions of the Hong Kong Civil Aviation (Investigation of Accidents) Regulations (Cap 448 sub. leg.). Cap 483A s 42 Aircraft parking Without prejudice to any directions that may be given by the Director or except in the case of emergency, no person shall place an aircraft other than in the place and position designated from time to time for that aircraft by the Authority. Cap 483A s 43 Excluded area Sections 39, 40, 41 and 42 shall not apply to the apron designated exclusively for the business aviation centre or the Government Flying Service established under the Government Flying Service Ordinance (Cap 322). Cap 483A s 44 Securing aircraft Any stationary aircraft which is not in a hangar shall be parked or otherwise secured against movement. Any operator of an aircraft who fails to so park or secure an aircraft commits an offence. Cap 483A s 45 Contamination (1) The operator of an aircraft shall be responsible for any fuel spills, contamination or pollution of the movement area by such aircraft and shall take steps to promptly stop such spills, contamination or pollution and minimize the consequence and damage. (2) The Authority may charge the operator of an aircraft for the expenses incurred in remedying any breach of subsection (1) and recover such sums owing as a civil debt from such operator. Cap 483A s 46 Vehicle licensing PART VIII AIRSIDE TRAFFIC (1) All vehicles driven in the Restricted Area shall have an Airside Vehicle Licence issued by the Authority. The Authority may impose such conditions of issue as it may determine and such conditions may include but not be limited to- (a) the area within which the vehicle may only be driven; and (b) the insurance requirements relating to the vehicle.(2) The Authority may revoke or refuse to issue or renew an Airside Vehicle Licence at its absolute discretion, in particular if the vehicle fails to pass any of the examinations under section 47, or if there is any breach of the conditions of issue of the Airside Vehicle Licence or if it is in the interest of security, safety or operational expediency to do so. (3) Airside Vehicles are classified in accordance with Schedule 1 for the purpose of licensing. Cap 483A s 47 Vehicle examination (1) The Authority may require regular and random vehicle examinations to be conducted on any Airside Vehicle. The examinations shall be conducted by such persons and at such examination centre as may be designated by the Authority or such other locations as may be determined by the Authority. (2) To pass an Airside Vehicle examination, a vehicle has to comply with such airport vehicle safety standards as may be determined by the Authority and the provisions of the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.). Cap 483A s 48 Airside vehicular traffic control (1) The Authority may- (a) issue airside driving endorsement to such persons as the Authority may from time to time consider appropriate, subject to such terms and conditions as may be determined by the Authority from time to time; and (b) install traffic signs and ground markings in the Restricted Area for the purposes of directing, regulating and controlling vehicular traffic and vehicle parking.(2) Any vehicle which does not have a valid Airside Vehicle Licence, or which is not in an area expressly permitted by its Airside Vehicle Licence, may be removed by the Authority immediately from the Restricted Area or, as the case may be, such area, without prior notice. (3) A person who causes the death of another person by driving a vehicle dangerously within the Restricted Area commits an offence. (33 of 2000 s. 5) (4) Any person who drives a vehicle dangerously within the Restricted Area commits an offence. (33 of 2000 s. 5) (5) (a) Any person who drives a vehicle within the Restricted Area carelessly commits an offence. (b) A person drives carelessly within the meaning of this subsection if he drives a vehicle in the Restricted Area without due care and attention or without reasonable consideration for other persons within the Restricted Area.(6) (a) Unless a different speed limit is prescribed by the Authority for specific types of vehicles or for certain specific routes, no person shall within the Restricted Area drive a vehicle above 35 km per hour. (b) Where a different speed limit is prescribed by the Authority for specific types of vehicles or for certain specific routes, no person shall within the Restricted Area drive a vehicle of that type or on such specific route above the prescribed speed limit.(7) No person shall drive a vehicle within the Restricted Area without a valid driving licence permitting the driving of the class of vehicle concerned together with a valid airside driving endorsement issued by the Authority under subsection (1). (8) No person shall drive a vehicle or allow a vehicle to be driven in the Restricted Area if the vehicle does not have a valid Airside Vehicle Licence. (9) No person shall drive a vehicle in any part of the Restricted Area which is not expressly permitted by the Airside Vehicle Licence of such vehicle. (10) No person shall drive a vehicle on the manoeuvring area unless authorized by the Air Traffic Control. (11) No person shall, whilst driving in the movement area, fail to give way to an aircraft, whether taxiing under its own power or on tow. (12) No person shall fail to observe any traffic signs or ground markings whilst driving in the Restricted Area. (13) No person shall drive a vehicle in the Restricted Area unless he has normal colour vision and wears, if such requirements are stipulated in his driving licence, corrective lenses or hearing aids when driving. (14) No person shall park or leave or allow a vehicle to be parked or left at a location in the Restricted Area other than a vehicle parking area designated by the Authority. (15) The driver and the owner of a vehicle involved in a vehicular accident within the Restricted Area shall report the incident to the Apron Control within 48 hours after the accident. Any person who, without reasonable excuse, fails to so report commits an offence. Cap 483A s 49 Application PART IX LANDSIDE TRAFFIC This Part shall apply to all designated roads. Cap 483A s 50 Road Traffic Ordinance (1) The Road Traffic Ordinance (Cap 374) and its subsidiary legislation shall apply to all designated roads. When applied to the designated roads- (a) provisions of the Road Traffic Ordinance (Cap 374) and its subsidiary legislation shall be subject to the provisions of this Bylaw made under section 36(3) of the Ordinance and the exclusions and modifications set out in Schedule 2; (b) the definitions in the Ordinance or this Bylaw of "the Authority", "Bylaw Area", "Land Grant", "designated road", "Authorized Officer" and "Authorized Person" shall apply to the provisions of the Road Traffic Ordinance (Cap 374) and its subsidiary legislation; (c) references to "road" in the provisions of the Road Traffic Ordinance (Cap 374) and its subsidiary legislation shall include the designated roads; (d) references to "private road" in the provisions of the Road Traffic Ordinance (Cap 374) and its subsidiary legislation shall not include the designated roads; and (e) all references to sections, regulations and subregulations in the Road Traffic Ordinance (Cap 374) and its subsidiary legislation shall be references to such sections, regulations and subregulations as the same are modified by this Bylaw and they shall be so construed accordingly.(2) The provisions of the Road Traffic Ordinance (Cap 374) and its subsidiary legislation, applicable as modified, may be enforced by a police officer, a traffic warden or an Authorized Person. Cap 483A s 51 Impounding and removal of vehicles (1) A vehicle or thing (as the case may be)- (a) causing obstruction or remaining at rest in such condition or in such circumstances as may be likely to cause danger to other persons using the designated road, or to interfere with the use of the designated road; or (b) parked in contravention of the Road Traffic Ordinance (Cap 374) or any of its subsidiary legislation as the same are modified by this Bylaw,may be impounded or removed, or caused to be impounded or removed, by an Authorized Person or a police officer at the risk of its owner and may be detained or stored by the Authority. (2) Where the power of impounding or removing a vehicle under subsection (1) may be exercised by the persons therein mentioned, any such persons may fix an approved immobilization device to the vehicle. (3) The Authority may recover as a civil debt from the owner of such vehicle or thing such sum in respect of its impounding or removal and storage as may be fixed from time to time by the Authority, with the approval of the Commissioner for Transport. (4) A list of the sums fixed by the Authority under subsection (3) shall be published by the Authority in such manner as may be approved by the Commissioner for Transport. (5) Any vehicle or thing removed under subsection (1) may be detained by the Authority until it is either- (a) returned to the owner upon his full payment of the sums owing as provided under subsection (3); or (b) disposed of in accordance with regulation 12 of the Road Traffic (Parking on Private Roads) Regulations (Cap 374 sub. leg.), modified as set out below- (i) in subregulations (1) and (2)(a)(i), for the words "regulation 11", there shall be substituted "section 51 of the Airport Authority Bylaw (Cap 483 sub. leg.)"; (ii) in subregulations (1) and (2)(a), for the words "the owner of the private road concerned or an authorized officer in respect of that road", there shall be substituted the words "the Authority"; (iii) in subregulation (1)(a)(ii), for the words "regulation 11(4)", there shall be substituted "section 51(3) of the Airport Authority Bylaw (Cap 483 sub. leg.)".(6) No person shall without the consent of an Authorized Person remove, damage or interfere in any way with any approved immobilization device fitted to a vehicle under subsection (2). (7) In this section, "approved immobilization device" (认可锁车器具) has the same meaning as defined in the Road Traffic (Parking on Private Roads) Regulations (Cap 374 sub. leg.). Cap 483A s 52 Person who finds property PART X LOST PROPERTY (1) Any person who finds in the Bylaw Area any property which appears to have been lost or left behind shall not remove such property from the place it is found save for the purpose of handing over the same forthwith to the Authority. (2) A person who finds property in the circumstances referred to in subsection (1) shall, upon handing over the property to an Authorized Person, be deemed to have complied with the requirements of that subsection. Cap 483A s 53 Power to open packages, etc. Where any lost property found in the Bylaw Area is a package, bag or other receptacle, an Authorized Officer or an Authorized Person may cause such receptacle to be opened and the contents examined, or require the person claiming it to open it and submit it and its contents for examination, for the purpose of- (a) identifying and tracing the owner of the lost property; (b) ascertaining the nature of the contents; or (c) satisfying the Authority that the contents do not include any item or items which may put at risk the safety or security of the Airport, any aircraft or any air navigation installation.If any item of a nature referred to in paragraph (c) is found, the Authorized Officer (other than a police officer) or the Authorized Person shall report the matter to the police immediately. Cap 483A s 54 Disposal of lost property (1) All lost property found in the Bylaw Area which comes into the possession of the Authority shall be dealt with as follows- (a) perishable, noxious or otherwise offensive goods or articles may be disposed of by the Authority, as soon as practicable after they have come into the Authority's possession, by sale or otherwise as the Authority sees fit; (b) identification and travel documents, certificates or any other document which the Authority considers to be of an important or confidential nature may be disposed of by the Authority within such time they have come into the Authority's possession and in such manner as the Authority sees fit; and (c) all other goods or articles shall be retained by the Authority for a period of 3 months after they have come into its possession and, if at the end of that period they remain unclaimed, they shall be deemed to become the property of the Authority free of all other rights and encumbrances, and the Authority may dispose of them by sale or otherwise as the Authority sees fit.(2) If within a period of 6 months of any sale or disposal by the Authority under subsection (1)(a) or (c), the former owner or the person formerly entitled to the beneficial ownership of the goods or articles can establish his ownership to the satisfaction of the Authority, he shall be paid, subject to his providing the Authority with an indemnity in retention as the Authority may reasonably require, the proceeds of sale, if any, less all expenses incurred by the Authority for and incidental to the sale or disposal. (3) Save as provided in subsection (2), the Authority shall incur no liability whatsoever (other than liability for negligence or wilful default) to any person in respect of lost property as bailees or otherwise and no claim for damages or compensation shall be brought against it by any person in respect of the same. Cap 483A s 55 Power to require provision of personal particulars PART XI ENFORCEMENT AND PENALTIES (1) Subject to section 35(8) of the Ordinance, any person who is reasonably suspected of committing or attempting to commit any breach of this Bylaw shall provide information and proof of his name, address and the purpose of his being in the Bylaw Area to an Authorized Officer or an Authorized Person when required by such Authorized Officer or Authorized Person. (2) No person shall fail to give the requested information under subsection (1) without reasonable excuse or knowingly make a statement which is false or misleading as to a material particular in furnishing any information or in giving his name and address under subsection (1). Cap 483A s 56 Power of an Authorized Person relating to regulation of vehicular traffic (1) Without prejudice to any other provisions under this Bylaw, an Authorized Person in uniform may- (a) for the purpose of preventing or detecting the commission of an offence under Part VIII; or (b) if he reasonably suspects that the driver of a vehicle- (i) has committed an offence under Part VIII; or (ii) has been involved in an accident in the Restricted Area,exercise any of the powers specified in subsection (2) as may be appropriate in respect of any of the particular purposes or circumstances described in this subsection. (2) For the purposes of subsection (1), an Authorized Person in uniform may- (a) order, direct or signal the driver of a vehicle- (i) to stop the vehicle forthwith; or (ii) to proceed to any place so ordered, directed or signalled and to stop thereat;(b) require any person to give his name and address and to produce any document in his possession which is or contains evidence of his name and address; (c) require the driver of a vehicle to produce his driving licence for examination and to give the name and address of the registered owner of the vehicle where that information is within his knowledge; and (d) detain a vehicle until the vehicle can be delivered into the custody of a police officer. (L.N. 9 of 1998)(3) For the purpose of regulating vehicular and pedestrian traffic in the Restricted Area, an Authorized Person in uniform may order, direct or signal the driver of a vehicle- (a) to stop the vehicle forthwith; or (b) to proceed to any place so ordered, directed or signalled and to stop thereat.(4) Any person who fails to comply with an order, direction or signal given under subsection (2)(a) or (3), or any requirement made under subsection (2)(b) or (c), commits an offence. (L.N. 9 of 1998) Cap 483A s 57 Power of removal Every Authorized Officer and Authorized Person shall have the power to remove (if necessary by the use of reasonable force) from any part of the Bylaw Area- (a) any person whom he reasonably believes has, or suspects of having contravened or attempted to contravene a provision of any section; and (b) any animal, vehicle or article which is in an area in contravention of this Bylaw,without prejudice to any fine, penalty or charge which may be imposed in accordance with this Bylaw. Cap 483A s 58 Power to remedy The Authority may take any action to remedy any breach or contravention of this Bylaw or any Terms of Use and shall have the right to recover as a civil debt from the person in breach all costs and expenses incurred in carrying out such remedial action. Cap 483A s 59 Authorized Persons (1) The Board may from time to time appoint a person or a person of such class or description, whether or not an employee of the Authority, to exercise all or any of the powers exercisable by an Authorized Person under this Bylaw, including but without limitation the power under section 35(2)(f) of the Ordinance. (2) Without prejudice to subsection (1), the persons who are of the class or description set out in Schedule 3 are authorized to exercise the powers under section 43 of the Ordinance. (3) The signature of the Airport Management Director (whether in hand writing or in printed form) certifying the authorization as provided in subsection (1) and/or (2) shall be sufficient evidence in writing of such authorization for all purposes including that of section 35(8) of the Ordinance. (4) The Authority shall issue to each Authorized Person an identity card as evidence of his authorization under subsection (1) and/or (2) and such identity card shall contain such particulars as the Authority may from time to time determine. (5) An Authorized person shall, if so required by any person when exercising or attempting to exercise any power conferred on him or discharging or attempting to discharge any duty imposed on him under this Bylaw, produce the identity card issued to him under subsection (4). Cap 483A s 60 Terms of Use Notice of Terms of Use shall be deemed duly given by the Authority- (a) where the relevant Terms of Use are applicable to all persons using the Airport or the service or facility concerned, by display publicly at the Airport; or (b) where the relevant Terms of Use are only applicable to a person providing or operating a service in the Airport or an air carrier operating therein, by notice in writing served on such person or air carrier. Cap 483A s 61 Saving of the Authority's rights (1) Nothing in this Bylaw and no prosecution or step or action shall bar any further or other claim for damages or other remedy or relief available to the Authority against any person. (2) Any sum levied by or payable to the Authority under this Bylaw whether by way of damages, costs, loss, expense or otherwise shall be receivable by the Authority or its lawful agents as a debt due on demand and shall be enforceable as a civil debt. Cap 483A s 62 Penalties A person who contravenes any provision of this Bylaw set out in column 1 of Schedule 4 commits an offence and is liable to the penalty set out in column 3 of that Schedule opposite the reference to that section. Cap 483A Sched 2 MODIFICATION OF ROAD TRAFFIC ORDINANCE [section 50] PART I ROAD TRAFFIC ORDINANCE In this Part, all references to "section" or "subsection" are references to the relevant section or subsection of the Road Traffic Ordinance (Cap 374) unless otherwise expressly specified. 1. In section 40(3) and (4)(b), for the words "the Commissioner" there shall be substituted the words "the Authority". 2. In section 43- (a) in the heading, after the words "a police officer", there shall be added ", an Authorized Person"; (b) in subsection (1), after the words "A police officer", there shall be added ", an Authorized Person"; (c) in subsection (2), after the words "a police officer", there shall be added ", an Authorized Person". 3. In section 50, for everything from "Any person" to the dash, there shall be substituted "Any person who without the consent of the Commissioner, Commissioner of Police, Director of Highways or the Authority-". 4. In section 51- (a) for subsection (1)(a), there shall be substituted- "(a) in accordance with a permit issued under this Ordinance or as directed or authorized by the Authority; or";(b) in subsection (2), wherever after the word "Commissioner", there shall be added "or the Authority". 5. In sections 56(2), 63 and 67- (a) for sections 56(2), 63(4) and (7) and 67(1) and (2), after the words "police officer", there shall be added "or an Authorized Person"; (b) for section 63(3)(a)(ii) and (b), after the words "police officer", there shall be added "or a specified Authorized Person". 6. In section 60, for the words "or traffic warden in uniform", there shall be substituted the words "a traffic warden in uniform or an Authorized Person in uniform". 7. PART II ROAD TRAFFIC (PARKING) REGULATIONS In this Part, all references to "regulation" or "subregulation" are references to the relevant regulation or subregulation under the Road Traffic (Parking) Regulations (Cap 374 sub. leg.) unless otherwise expressly specified. 1. General (1) In applying the Road Traffic (Parking) Regulations (Cap 374 sub. leg.)- (a) all references in the Regulations to "the Commissioner", not being a reference to "the Commissioner of Police" or "the Government" shall be substituted by references to "the Authority"; (b) all references to "Crown land" shall be replaced by "Bylaw Area".(2) For the avoidance of doubt, these regulations shall not be construed howsoever to prejudice or limit the rights of the Authority or operators of car parks and car parking places which are to be operated on a commercial basis, in determining the terms and conditions, including fees chargeable, on which such car parks and car parking places are to be offered for use to the public. 2. In regulation 2(3), there shall be added "and in Schedule 6 to the Airport Authority Bylaw (Cap 483 sub. leg.)" after "Schedule 1". 3. Regulation 3(2) shall be omitted. 4. In regulation 4- (a) for subregulation (1), there shall be substituted- "(1) No person shall park a vehicle at any place to which Part IX of the Airport Authority Bylaw (Cap 483 sub. leg.) applies except at a parking place or area designated by the Authority for the parking of that type of vehicles and no person shall park a vehicle in contravention of any prescribed traffic sign or road marking.";(b) for subregulation (2), there shall be added "and by the erection or placing of parking signs in accordance with Figures Nos. 1 and 2 in Schedule 6 to the Airport Authority Bylaw (Cap 483 sub. leg.)" after "Schedule 1"; (c) subregulations (3), (4) and (6) shall be omitted; (d) for subregulation (5), there shall be substituted- "(5) Any person who contravenes subregulation (1) commits an offence and is liable to a fine of $2000.". 5. In regulation 5(1) and (2A), there shall be added "and by the erection or placing of parking signs in accordance with Figures Nos. 1 and 2 in Schedule 6 to the Airport Authority Bylaw (Cap 483 sub. leg.)" after "Schedule 1". 6. In regulation 6- (a) in the heading, after the words "Commissioner of Police", there shall be added "or the Authority"; (b) in subregulations (1), (2) and (3), after the words "Commissioner of Police", there shall be added "or the Authority". 7. In regulation 10(a)(ii), for the words "the Director of Highways" there shall be substituted the words "the Authority". 8. For regulation 11(3), there shall be substituted- "(3) The fees to be charged for use of parking spaces in the Bylaw Area shall be determined from time to time by the Authority.". 9. For regulation 14, there shall be substituted- "14. Designation of car parks The Authority may, subject to the provisions of the Land Grant, designate any place as a car park and may limit the use of such car park or any part thereof to any particular class or type of motor vehicle and may revoke or amend any such designation.". 10. Regulations 15, 17, 18, 21, 23 and 24 shall be omitted. 11. For regulation 20, there shall be substituted- "20. Car park fees The fees for use of car parks shall be determined by the Authority from time to time.". 12. For regulation 22, there shall be substituted- "22. Monthly passes The Authority may issue monthly pass for use of car parks on such terms and conditions and on payment of such fee as the Authority may determine.". 13. In regulation 25(1)- (a) paragraph (f) shall be omitted; (b) for paragraph (j), the words "under regulation 15" shall be omitted. 14. For regulation 28, there shall be substituted- "28. Limitation of liability The exercise by the Authority of its powers or functions under regulation 5, the exercise by the operator of his functions under regulation 5(3) or the exercise by the Commissioner of Police or the Authority or his or, as the case may be, its functions under regulation 6 shall not render any of them subject to any liability in respect of the loss of or damage to any vehicle in a parking place or car park or the contents of any such vehicle.". PART III ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) REGULATIONS In this Part, all references to "regulation", "subregulation" or "Part" are references to the relevant regulation, subregulation or Part under the Road Traffic (Public Service Vehicles) Regulations (Cap 374 sub. leg.) unless otherwise expressly specified. 1. Part IV In Part IV, all references to "the Commissioner", not being a reference to "the Commissioner of Police", there shall be substituted "the Commissioner or the Authority in consultation with the Commissioner". 2. Regulations 31 and 32 For regulations 31 and 32, after the words "Commissioner of Police", there shall be added "or the Authority". PART IV ROAD TRAFFIC (REGISTRATION AND LICENSING OF VEHICLES) REGULATIONS In this Part, all references to "regulation" or "subregulation" are references to the relevant regulation or subregulation under the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.) unless otherwise expressly specified. 1. In regulation 49- (a) in subregulation (1)- (i) after the words "may apply to the Commissioner", there shall be added "or, in the case of the closure of a road by the Authority under regulation 27 of the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.), modified as set out in section 1 of Part V of Schedule 2 to the Airport Authority Bylaw (Cap 483 sub. leg.), the Authority, with the approval of the Commissioner,"; (ii) after the words "and the Commissioner", there shall be added "or the Authority, with the approval of the Commissioner,"; (iii) after the words "as the Commissioner", there shall be added "or the Authority, with the approval of the Commissioner,";(b) for subregulation (3), there shall be substituted- "(3) The Authority may charge a fee for the issue of a closed road permit, such fee to be determined by the Authority with the approval of the Commissioner.";(c) subregulation (4) shall be omitted. 2. In regulation 50(1)- (a) after the words "may apply to the Commissioner", there shall be added "or, in the case of a prohibited zone or a restricted zone designated by the Authority under regulation 14 of the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.), modified as set out in section 1 of Part V of Schedule 2 to the Airport Authority Bylaw (Cap 483 sub. leg.), the Authority, with the approval of the Commissioner,"; (b) there shall be added "The Authority may, in the case of a prohibited zone or a restricted zone designated by the Authority under regulation 14 of the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.), modified as set out in section 1 of Part V of Schedule 2 to the Airport Authority Bylaw (Cap 483 sub. leg.), issue such a permit subject to such conditions and in respect of such period as may be determined by the Authority with the approval of the Commissioner" at the end. PART V ROAD TRAFFIC (TRAFFIC CONTROL) REGULATIONS In this Part, all references to "regulation", "subregulation" or "Schedule" are references to the relevant regulation, subregulation or Schedule under the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) unless otherwise expressly specified. 1. In regulations 3(1) and (2), 8(1) and (3), 9, 14(1) and (4), 27(1) and (2), 30(1) and 40(1)- (a) for regulations 3(1) and (2), 8(1) and (3), 14(1) and (4), 30(1) and 40(1), after the words "The Commissioner", there shall be added "or, the Authority with the approval of the Commissioner,"; (b) for regulations 3(1), 8(1), 9 and 27(1) and (2), after the words "the Commissioner", there shall be added "or, the Authority with the approval of the Commissioner,". 2.
