(Cap 358 section 46) [1 April 1987] L.N. 90 of 1987 (L.N. 149 of 1986) Cap 358D reg 1 Citation PART I PRELIMINARY (L.N. 324 of 1994) These regulations may be cited as the Water Pollution Control (General) Regulations. (Enacted 1986) Cap 358D reg 2 Interpretation (1) In these regulations, unless the context otherwise requires- "business registration no." (商业登记号码) means the number assigned by the Commissioner of Inland Revenue under the Business Registration Ordinance (Cap 310) to any business registration certificate held by the applicant; (L.N. 375 of 1990) "code number" (代码编号) means the number assigned for record purposes by the Authority to any notification or application received by him or to any licence, renewal or variation granted by him; "commercial premises" (商业处所) means premises, not being industrial premises, used for the purpose of commerce or trade; (L.N. 375 of 1990) "discharge point" (排放点) means the point at which a discharge or a deposit first enters or is first likely to enter- (a) any communal drain or communal sewer; or (b) the waters of Hong Kong; (L.N. 375 of 1990; L.N. 324 of 1994)"domestic premises" (住用处所) means any premises used exclusively for residential purposes and constituting a separate household unit; (L.N. 375 of 1990) "domestic sewage" (住宅污水) has the meaning ascribed to that term in section 9(3) of the Ordinance; "domestic sewage treatment plant" (住宅污水处理装置) means a plant at which domestic sewage is treated and in which 2 or more of the following categories of items are employed- (a) a grit trap; (b) a screen; (c) a comminutor; (d) a sedimentation or settlement tank; (e) aeration; (f) biological treatment through the action of micro-organisms; (g) a submarine pipeline leading to receiving waters;"flow rate" (流量率) in relation to any discharge or deposit means the volume per unit time of a discharge or deposit from any premises when- (a) measured by a flow meter certified by its manufacturer to have a reading accuracy of within +/- 3%; or (L.N. 324 of 1994) (b) estimated by the Authority having regard to the relevant water consumption of that premises and the number of hours worked during the period to which the water consumption relates,and averaged over the period of operation in a working day; (L.N. 375 of 1990) "Form A" (A表) means Form A in the Second Schedule; (L.N. 375 of 1990) "grant of a licence" (批给牌照) means the grant of a licence under section 20 of the Ordinance; "ID card" (身分证) means an identity card issued under the Registration of Persons Ordinance (Cap 177); "industrial enterprise" (工业企业) means a person who carries on an industrial process by way of trade or business; "industrial premises" (工业处所) means premises occupied by an industrial enterprise for the purpose of carrying on an industrial process by way of trade or business, whether or not such premises form part of larger premises occupied by the same or another industrial enterprise or by any other person; "industrial process" (工业工序) means a process which gives rise to a discharge or deposit other than a discharge or deposit from a domestic sewage treatment plant; (L.N. 375 of 1990) "institutional premises" (机构处所) means any premises other than- (a) domestic premises; (b) industrial premises; or (c) commercial premises; (L.N. 375 of 1990)"last notice" (最后公告) means the last notice referred to in section 19(4) of the Ordinance; "manager" (经理) in relation to an industrial enterprise or domestic sewage treatment plant means an individual resident in Hong Kong who is responsible for the management in Hong Kong of that industrial enterprise or domestic sewage treatment plant, as the case may be; "renewal of a licence" (牌照续期) means the renewal of a licence by virtue of section 23 or 23A of the Ordinance; (L.N. 375 of 1990) "sampling point" (抽样点) means one or more points, whether or not a point or points specified in the licence, at which samples of a discharge or deposit are taken by the Authority as being representative of the quality and quantity of the discharge or deposit; (L.N. 324 of 1994) "statutory public notice" (法定公告) means a notice which the Authority causes to be published under section 19(3)(b) of the Ordinance; "sub-zone" (分区) means a part of a water control zone delineated by the Secretary under section 5(5) of the Ordinance for the purpose of establishing different water quality objectives for different parts of that zone; "variation of a licence" (更改牌照) means the variation of a licence under section 28 of the Ordinance; "water account number" (水费用户编号) in relation to any premises means the account number allocated by the Water Authority under the Waterworks Ordinance (Cap 102) in respect of the consumption of water. (L.N. 375 of 1990) (2) (Repealed L.N. 375 of 1990) (L.N. 375 of 1990; L.N. 324 of 1994) Cap 358D reg 3 (Repealed L.N. 375 of 1990) Cap 358D reg 4 (Repealed L.N. 375 of 1990) Cap 358D reg 5 Particulars to be included in statutory public notices PART II STATUTORY PUBLIC NOTICES (L.N. 324 of 1994) Subject to section 43 of the Ordinance, every statutory public notice shall contain the following particulars- (a) a heading to the effect that the notice is published under section 19(3) of the Ordinance and that the application of which it gives particulars has been received by the Authority; (b) the type of application under the Ordinance to which the notice relates, specifying whether it is for the grant of a licence, for renewal of a licence, or for variation of a licence; (c) the type of discharge or deposit, specifying whether it is from industrial premises or from a domestic sewage treatment plant or where it is from any other source, specifying such source; (d) the name (if any) of the industrial enterprise and the location of the relevant industrial premises, and the name (if any) and the location of domestic sewage treatment plant or other source, as the case may be, to which the application relates; (e) (Repealed L.N. 375 of 1990) (f) the maximum flow rate of the discharge or deposit from the industrial premises, domestic sewage treatment plant or other source, as the case may be; (L.N. 324 of 1994) (g) the receiving waters, specifying either- (i) in the case of discharge to or deposit in the waters of Hong Kong, the name of the water control zone and of the sub-zone, if any, within which the waters lie; (ii) in the case of discharge to or deposit in a communal drain or communal sewer flowing into the waters of Hong Kong, the name of the water control zone and sub-zone, if any, within which those waters lie;(h) (Repealed L.N. 375 of 1990) (i) the expected temperature of the discharge or deposit the subject of the application; (j) a statement of any method proposed by the applicant for treating the discharge or deposit before it reaches the discharge point; (k) where the application is for variation of a licence, a brief statement of any new components to be added to the discharge or deposit; (l) a statement of the grounds on which and the manner in which objections may be made to the application the subject of the notice (including the fact that objections must be made in writing to the Authority and received within 30 days of last publication of the notice). (Enacted 1986. L.N. 375 of 1990) Cap 358D reg 6 Notice may relate to more than one application A statutory public notice may relate to more than one application under the Ordinance but must give the particulars prescribed in regulation 5(b) to (k) in respect of each application to which it relates. (Enacted 1986) Cap 358D reg 7 Form of notice Every statutory public notice shall be in the form set out in the First Schedule, or as near thereto as the circumstances permit. (Enacted 1986) Cap 358D reg 8 Procedure for application for renewal of a licence PART III LICENCES (L.N. 324 of 1994) (1) An application for a licence or renewal or variation of a licence under the Ordinance shall be made in Form A. (L.N. 375 of 1990) (2) Every application for renewal of a licence shall be made not earlier than 4 months and not later than 2 months before the date of expiry of the licence. (L.N. 324 of 1994) (Enacted 1986) Cap 358D reg 9 Status of licence pending decision on renewal A licence which is the subject of an application for renewal made in accordance with regulation 8 shall continue in force until the Authority either grants or refuses the application and in the event of the Authority refusing the application shall continue in force until the expiry of the time for appealing under section 29(3) of the Ordinance. If an applicant for renewal appeals against a refusal by the Authority to grant such renewal, the licence shall continue in force until the determination of the appeal. (Enacted 1986) Cap 358D reg 10 Late applications for renewal (1) Notwithstanding regulation 8(2), if an application for renewal of a licence is received by the Authority less than 2 months before the date of expiry of the licence, the Authority shall nevertheless entertain the application, but the licence shall cease to be in force from the date of its expiry unless and until it is renewed by the Authority or by an Appeal Board. (L.N. 324 of 1994) (2) An application for renewal of a licence received by the Authority after the date of expiry of the licence shall not be entertained by the Authority. (Enacted 1986) Cap 358D reg 11 Notice of objection to the grant of a licence If a person wishes to object to the grant of a licence, the renewal of a licence or the variation of a licence, application for which has been the subject of a statutory public notice, he shall give notice of such objection to the Authority in writing by registered post within the time specified in section 19(4) of the Ordinance. (Enacted 1986. L.N. 375 of 1990) Cap 358D reg 12 Contents of notice of objection (1) A notice of objection under regulation 11 shall include the full name and postal address of the person making the objection and shall be signed by that person or by some individual authorized to sign on behalf of that person. (2) A notice of objection shall set out the reasons for the objection with sufficient particularity to enable the Authority to determine- (a) whether the granting of the application would tend to inhibit the attainment or maintenance of the relevant water quality objective; and (b) whether he should hold a hearing under section 41 of the Ordinance before deciding whether to grant the application. (Enacted 1986) Cap 358D reg 13 (Repealed L.N. 375 of 1990) Cap 358D reg 14 Registration of applications for licences (1) The register shall contain the following particulars of every application to license a discharge or deposit which is made to the Authority under section 14 or 19 of the Ordinance- (a) the date of the application; (b) the name of the applicant; (c) the location of the industrial premises, domestic sewage treatment plant or other source, as the case may be, from where the discharge or deposit is made; (d) the name of the industrial enterprise or of the manager of the plant, if different from the applicant or in case of a discharge or deposit from any other source, the name (if any) of the source, or the name of the person in charge thereof, if different from the applicant; (e) the result of the application and the date on which the licence was granted or refused; (f) the code number assigned by the Authority to the application.(2) Subject to section 43 of the Ordinance, the register shall in respect of every application for a licence contain a copy of Form A, as completed by the applicant and lodged with the Authority. L.N. 375 of 1990) Cap 358D reg 15 Registration of applications for variation or renewal (1) (Repealed L.N. 375 of 1990) (2) The register shall contain the following particulars of every application for renewal or variation of a licence which is made to the Authority under section 23, 23A or 28 of the Ordinance respectively- (a) the date of the application; (b) the name of the applicant; (c) the location of the industrial premises, domestic sewage treatment plant or other source, as the case may be, from where the discharge or deposit is made; (d) the name of the industrial enterprise or of the manager of the plant, if different from the applicant or in case of a discharge or deposit from any other source, the name (if any) of the source, or the name of the person in charge thereof, if different from the applicant; (e) the code number assigned by the Authority to the original licence; (f) the code number assigned by the Authority to any previous variation or renewal of the licence; (g) the result of the application and the date on which the variation or renewal was granted or refused; (h) the code number assigned by the Authority to the application.(3) Subject to section 43 of the Ordinance, the register shall in respect of every application for renewal or variation of a licence contain a copy of Form A, as completed by the applicant and lodged with the Authority. L.N. 375 of 1990) Cap 358D reg 15A Compensation on basis of relocation of activity where licence cancelled PART IV ASSESSMENT OF COMPENSATION (1) This regulation applies where compensation payable under section 25(1) or 26(2) of the Ordinance in respect of the cancellation of a licence falls to be determined by reference to loss arising from the relocation to another site, as a result of such cancellation, of any activity lawfully being carried on at the time of the cancellation. (2) Subject to subregulation (3), in determining the amount of compensation referred to in subregulation (1) there shall be taken into account the following factors- (a) the reasonable cost of relocating to a new site within Hong Kong by the most reasonable route and means of transportation- (i) any equipment used in the activity at the time of the cancellation; (ii) any materials held for use in the activity at the time of the cancellation; (iii) any semi-finished and finished products of the activity at the time of the cancellation;(b) the reasonable cost of installing at the new site the equipment referred to in paragraph (a)(i); (c) if any licence condition at the new site is more stringent than the corresponding licence condition at the old site, or if there is any licence condition at the new site that did not apply at the old site, the reasonable cost of upgrading the equipment to meet the more stringent or new licence condition.(3) Nothing in subregulation (2) shall be construed as including under that subregulation- (a) the cost of identifying any new site for relocation of the activity or of arranging for the relocation; (b) any damage to equipment or materials incurred during or as a result of relocation; (c) except as provided in subregulation (2)(c), the cost of upgrading equipment at the new site; (d) any operating or maintenance costs at the new site.(4) Any factor that is not specified in subregulation (2) shall be disregarded for the purpose of determining an amount of compensation referred to in subregulation (1). (L.N. 324 of 1994) Cap 358D reg 15B Compensation on basis of modification and adaptation of activity where licence cancelled (1) This regulation applies where compensation payable under section 25(1) or 26(2) of the Ordinance in respect of the cancellation of a licence falls to be determined by reference to loss arising from the necessary modification or adaptation, as a result of such cancellation, of any activity lawfully being carried on at the time of the cancellation so as to enable the activity lawfully to continue at the existing site. (2) In determining the amount of compensation referred to in subregulation (1) there shall be taken into account the following factors- (a) the depreciated value of any equipment used in the activity at the time of the cancellation that must be replaced in order to enable the activity to continue; (b) the difference between the cost and the value on disposal of raw materials and semi-finished products acquired for or produced by the activity referred to in paragraph (a) which can no longer be used in the activity; (c) the reasonable cost of installing waste recovery and treatment systems to the extent necessary to enable the activity lawfully to continue; (d) the reasonable cost of changing or upgrading any equipment so as to enable the activity lawfully to continue; (e) any additional operational and maintenance costs incurred as a result of any upgrading referred to in paragraph (d) in respect of the balance of the period under the licence immediately prior to its cancellation.(3) Any factor that is not specified in subregulation (2) shall be disregarded for the purpose of determining an amount of compensation referred to in subregulation (1). (L.N. 324 of 1994) Cap 358D reg 15C Compensation on basis of cessation of activity where licence cancelled (1) This regulation applies where compensation payable under section 25(1) or 26(2) of the Ordinance in respect of the cancellation of a licence falls to be determined by reference to loss arising from the closing down or ceasing, as a result of such cancellation, of any activity lawfully being carried on at the time of the cancellation. (2) In determining the amount of compensation referred to in subregulation (1) there shall be taken into account the following factors- (a) the depreciated value of any equipment used in the activity at the time of the cancellation; (b) the difference between the cost and the value on disposal of raw materials and semi-finished products acquired for or produced by the activity referred to in paragraph (a).(3) Any factor that is not specified in subregulation (2) shall be disregarded for the purpose of determining an amount of compensation referred to in subregulation (1). (L.N. 324 of 1994) Cap 358D reg 15D Compensation for variation of licence (1) This regulation applies where compensation is payable under section 25(1) or 26(2) of the Ordinance in respect of the variation of a licence so as to impose an additional obligation on the person making a discharge or deposit. (2) In determining the amount of compensation referred to in subregulation (1) there shall be taken into account the following factors- (a) the reasonable cost of upgrading any equipment to the extent necessary to meet any such additional obligation imposed; (b) any additional operating and maintenance costs reasonably incurred as a result of such upgrading for the remainder of the period covered by the licence.(3) Any factor that is not specified in subregulation (2) shall be disregarded for the purpose of determining an amount of compensation referred to in subregulation (1). (L.N. 324 of 1994) Cap 358D reg 16 Mode of service of documents PART V MISCELLANEOUS (L.N. 324 of 1994) (1) Unless the Ordinance expressly provides otherwise, a document authorized or required to be served under the Ordinance may be served- (a) by sending it by registered post to the last known address of the person to be served; or (b) where the person who is to be served with the document is an industrial enterprise occupying industrial premises or the owner or manager of a domestic sewage treatment plant, by affixing the document to some conspicuous part of the premises or plant, as the case may be.(2) Where the person to be served is an individual a document may be served by delivering it to that individual or sending it by registered post to his last known place of residence. (3) Where the person to be served is a company a document may be served by leaving it at or sending it by registered post addressed to the registered office of the company. (Enacted 1986) Cap 358D reg 17 Forms (1) The form in the Second Schedule is prescribed for the purposes of the Ordinance. (2) A person who, in completing the form prescribed in the Second Schedule, makes a statement or gives an estimate which he knows to be incorrect in a material particular or recklessly makes a statement or gives an estimate which is incorrect in a material particular or knowingly omits a material particular, commits an offence and is liable to a fine of $10000. (Enacted 1986. L.N. 375 of 1990) Cap 358D reg 17A Authority may obtain information The Authority may, in the exercise of his powers under section 35 of the Ordinance, obtain information relating to- (a) any matter in relation to which particulars are required to be supplied in Form A; (b) any discharge or deposit, including but not limited to- (i) periods or times during which the discharge or deposit is made; (ii) particulars of any process, plant or equipment involved in making the discharge or deposit. L.N. 375 of 1990; L.N. 324 of 1994) Cap 358D reg 17B Offence for contravention of licence provision (1) A person who contravenes any of the provisions of a licence granted under the Ordinance as are specified in subregulation (2) commits an offence and is liable to a fine of $200000 and to imprisonment for 6 months. (2) The provisions specified for the purpose of subregulation (1) are any provision- (a) stipulating a limit of a characteristic or constituent of a discharge or deposit; (b) requiring that a discharge or deposit shall not contain any prohibited substance; (c) requiring or specifying the desludging of a septic tank or the keeping of records of sludge removed in any desludging; (d) requiring or specifying the proper disposal of sludge removed in the desludging of a septic tank; (e) requiring or specifying the keeping of records of sludge or screenings removed from a domestic sewage treatment plant or a wastewater treatment facility, or the proper disposal of such sludge or screenings; (f) requiring or specifying the provision, operation or maintenance of a wastewater treatment facility; (g) requiring or specifying the provision of standby wastewater treatment equipment; (h) requiring or specifying the provision of a sampling point or suitable and accessible facilities at such a point; (i) requiring or specifying the provision, operation or maintenance of any equipment, facility or device for measuring a characteristic or constituent of a discharge or deposit; (j) requiring or specifying the carrying out of routine self-monitoring, recording or analyzing of a characteristic or constituent of a discharge or deposit or the making available of the results of such monitoring, recording or analyzing to the Authority; (k) requiring or specifying notification to the Authority of any emergency affecting compliance with the licence; (l) requiring or specifying notification to the Authority of any circumstance that may alter a characteristic or constituent of a discharge or deposit. (L.N. 324 of 1994) Cap 358D reg 18 Fees There shall be paid to the Authority in relation to the matters mentioned in the second column of the Third Schedule, the fees specified in the third column of that Schedule.
